In using this website you are deemed to have read and agreed to the following terms and conditions:
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing UK Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Price variation – Quotes are based on Pointmedia Creative Ltd current costs of production and, unless otherwise agreed, are subject to amendment on or at any time after acceptance to meet any rise or fall in such costs.
Tax – Pointmedia Creative Ltd reserves the right to charge the amount of any value added tax payable whether or not included on the estimate or invoice.
Preliminary work – All work carried out, whether experimentally or otherwise, at customer’s request shall be charged.
Electronic files –
A charge may be made to cover any additional work involved where files supplied is not clear and legible, and are not supplied to our specification.
Files supplied not to agreed schedules will require re-negotiation of despatch timings and may be subject to additional costs.
It is the customer’s responsibility to maintain a copy of any original electronic file. All files copied to and/or generated by any means will automatically be removed from Pointmedia Creative Ltd servers seven days after despatch of job, unless archiving had previously been agreed.
Archiving of electronic files for future use is charged at one pound sterling per one megabyte of copy (minimum charge twenty five pounds sterling) and is payable in advance.
All electronic storage media e.g. discs, zips, dvd, drives, etc. supplied by the customer will be discarded fourteen days after invoice unless requested in writing by the customer to be returned, in which case a charge shall be incurred.
Pointmedia Creative Ltd shall not be responsible for checking the accuracy of supplied input from an electronic file.
All data must be supplied to Pointmedia Creative Ltd technical specifications and without prejudice to clause 15, if an electronic file is not suitable for outputting on equipment normally adequate for such purposes without adjustment or other corrective action , such corrective action will incur additional charges.
Proofs – All proofs may be submitted for customer’s approval and the printer shall incur no liability for any errors not corrected or checked by the customer in proofs so submitted. Customer’s alterations and additional proofs necessitated thereby shall be charged extra. When style, type or layout is left to the printer’s judgment, changes thereafter made by the customer shall be charged extra.
Proofing- Due to variations in equipment, paper, inks and other conditions between colour proofing and actual production runs, a reasonable variation in colour between colour proofs and the completed job will be deemed acceptable. Where the greatest degree of accuracy is imperative, it is highly recommended to order wet proofs produced on the intended press as these can be guaranteed to produce more accurate results.
Variations in quantity – Unless otherwise agreed in writing , all quantities delivered shall be subject to a variation of plus or minus ten percent of the quantity ordered. No credit will be given for shortages falling within this tolerance.
Despatch and payment –
All major Credit/Debit Cards are all acceptable methods of payment. There is (a) 2% service charge on all Credit/Debit Cards. Unless otherwise agreed in writing, all work and goods produced shall be liable for payment prior to commencement. We may provide 30 days credit subject to agreement with Pointmedia Creative Ltd from the invoice date, and will be invoiced at the point of completion in whole or in part, regardless of whether a client has requested a deferred despatch date.
Unless otherwise specified the price is for despatch of the work to the customer’s address as set out in the estimate. A charge may be made to cover any extra costs involved for despatch to a different address.
Should expedited despatch be agreed an extra charge will be incurred to cover any additional costs.
In the case of work being suspended at the request of, or delayed through any default of the customer, Pointmedia Creative Ltd shall be entitled to payment for work already carried out, materials ordered and other additional costs involved, including storage.
In the case of work being cancelled by the customer, Pointmedia Creative Ltd shall be entitled to payment for work already carried out, materials ordered and other additional costs involved, including all allocated and scheduled production hours which are no longer saleable.
Storage is charged at ten pounds sterling per whole or part pallet/reel per day.
Pointmedia Creative Ltd reserve the right to charge late payment interest at three percent above The Bank Of Scotlands base rate.
Ownership and risk –
The risk in all goods delivered, in whole or in part, in connection with the work shall pass to the customer on despatch.
Goods supplied by the printer remain Pointmedia Creative Ltd’s property until the customer has paid for them in full and discharged all other debts owing to the printer.
If the customer becomes in default of their agreed credit terms and the goods have not been paid for in full Pointmedia Creative Ltd will be entitled to recover, or inspect the goods without notice and, if necessary, enter the customer’s premises to do so. All additional costs will be charged extra.
Pointmedia Creative Ltd reserve the right to withdraw all credit facilities without any prior notice.
Claims Advice of damage, quality, delay or loss of goods in transit or of non-despatch must be given in writing to Pointmedia Creative Ltd within seven days of despatch and any claim in respect thereof must be made in writing to Pointmedia Creative Ltd with photographic and written evidence by recorded despatch. Pointmedia Creative Ltd shall not be liable in respect of any claim unless the aforementioned requirements have been complied with.
Liability –
Pointmedia Creative Ltd should not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to the customer arising from delay in transit, whether as a result of the printer’s negligence or otherwise.
Insofar as is permitted by law where work is defective for any reason, including Pointmedia Creative Ltd’s liability (if any) shall be limited to rectifying such defect. Where Pointmedia Creative Ltd performs its obligations to rectify defective work under this condition the customer shall not be entitled to any further claim in respect of the work done nor shall the customer be entitled to treat despatch thereof as a ground for repudiating the contract, failing to pay for the work or canceling further deliveries. Pointmedia Creative Ltd does not accept consequential loss.
Nothing in these conditions shall exclude Pointmedia Creative Ltd’s liability for death or personal injury as a result of its negligence.
Standing material –
Metal, film and other materials used by Pointmedia Creative Ltd in the production of type, plates, film-setting, negatives, positives and the like shall remain Pointmedia Creative Ltd exclusive property.
Pointmedia Creative Ltd shall not be re Pointmedia Creative quired to download any digital data from his equipment or supply the same to the customer on disk, tape or by any communication link unless written arrangements are made to the contrary.
Customer’s property – Customer’s property and all property supplied to Pointmedia Creative Ltd by or on behalf of the customer shall while it is in the possession of Pointmedia Creative Ltd or in transit to or from the customer be deemed to be at customer’s risk and the customer should insure accordingly.
Materials supplied by the customer –
Pointmedia Creative Ltd may reject any film, disks, paper, plates or other materials supplied or specified by the customer which appear be unsuitable to Pointmedia Creative Ltd. Costs incurred if materials are found to be unsuitable during production will be charged.
Where materials are so supplied or specified, Pointmedia Creative Ltd will take every care to secure the best results, but responsibility will not be accepted for imperfect work caused by defects in or unsuitability of materials so supplied or specified.
Quantities of materials supplied shall be adequate to cover all aspects of production including spoilage, and shall be agreed prior to order.
Insolvency – Without prejudice to other remedies, if the customer becomes insolvent (namely, being a company is deemed to be unable to pay its debts or has a winding up petition issued against it or has a receiver, administrator or administrative receiver appointed to it or being a person commits an act of bankruptcy or has a bankruptcy petition issued against him) Pointmedia Creative Ltd shall have the right not to proceed further with the contract or any other work for the customer and be entitled to charge for work already carried out (whether completed or not) and materials purchased for the customer, such charge to be an immediate debt due to him. Any unpaid invoices shall become immediately due for payment.
General Lien – Without prejudice to other remedies, in respect of all unpaid debts due from the customer Pointmedia Creative Ltd shall have a general lien on all goods and property in his possession (whether worked on or not) and shall be entitled on the expiration of fourteen days’ notice to dispose of such goods or property as agent for the customer in such manner and at such price including administration costs as he thinks fit and to apply the proceeds towards such debts.
Illegal matter –
Pointmedia Creative Ltd shall not be required to print any matter which in his opinion is or may be of an illegal or libellous nature or an infringement of the proprietary or other rights of any third party.
Pointmedia Creative Ltd shall be indemnified by the customer in respect of any claims, costs and expenses arising out of any libellous matter or any infringement of copyright, patent, design or of any other proprietary or personal rights contained in any material printed for the customer. The indemnity shall include (without limitation) any amounts paid on a lawyer’s advice in settlement of any claim that any matter is libellous or such an infringement.
Periodical publications – A contract for the printing of a publication may not be terminated by the customer unless thirteen weeks notice in writing is given in the case of periodicals produced at monthly intervals or less , and twenty six weeks notice for publications produced at more than monthly intervals.
Force majeure – Pointmedia Creative Ltd shall be under no liability if he shall be unable to carry out any provision of the contract for any reason beyond his reasonable control including (without limiting the foregoing): Act of God; legislation; war; fire; flood; drought; inadequacy or unsuitability of any instructions, electronic file or other data or materials supplied by the customer; failure of power supply; lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute; or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the customer may by written notice to Pointmedia Creative Ltd elect to terminate the contract and pay for work done and materials used and ordered, but subject thereto shall otherwise accept despatch when available.
Law – These conditions and all other express and implied terms of the contract shall be governed and construed in accordance with the laws of Scotland.
